s <br /> WA <br /> RESOLUTION NO. <br /> RESOLUTION SETTING TIME AND PLACE FOR PUBLIC HEARING ON <br /> PROPOSED CHANGES TO THE "CODE OF ORDINANCES OF THE CITY <br /> OF CLIVE, IOWA, 1986" WITH RESPECT TO AMENDING THE <br /> OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES <br /> (SECTION 5 OF ORDINANCE NO. 248) FOR CERTAIN PROPERTY IN <br /> THE CITY OF CLIVE, IOWA. <br /> • WHEREAS, the following legally described land is located in <br /> the City of Clive, Iowa: <br /> A parcel of land in the northwest 1/4 of Section 31, <br /> Township 79 North, Range 25 west of the 5th P.M., City of <br /> Clive, Polk County, Iowa that is more particularly <br /> described as follows: <br /> Beginning at the northwest corner of Country Club Plat 5, <br /> an official plat, thence S00'00'22 "W, 650.00 feet along <br /> the west line of said Plat 5 to a point; thence S06' <br /> 37'43 "E, 171.66 feet along said west line to a point on a <br /> curve; thence easterly along a curve to the right having <br /> a radius of 721.86 feet, an arc length of 13.80 feet, and <br /> a chord bearing of N83'55'09 "E to a point; thence S10' <br /> 36'58 "E, 146.44 feet along said west line to a point; <br /> thence S74' 44'34 "W, 332.33 feet to a point; thence <br /> S68'18'54 "W, 208.89 feet to a point; thence 564'54'52 "W, <br /> 272.63 feet to a point on the North line of Country Club <br /> Plat 3, an official plat; thence N62'31'26 "W, 224.02 feet <br /> along said north line to a point; thence N74'47'01 "W, <br /> 336.86 feet along said north line to a point; thence <br /> N89'45'54 "W, 290.27 feet along said north line to a point <br /> on the West line of said Section 31; thence N00'14'06 "E, <br /> 1125.81 feet along said west line to the Northwest corner <br /> of said Section; thence 589'59'38 "E, 1510.66 feet along <br /> the north line of said Section to a point.; thence <br /> 500'00'22 "W, 75.40 feet to the point of beginning and con <br /> taining 41.019 acres more or less. <br /> WHEREAS, the City Council of the City of Clive has received a <br /> petition signed by the owners of over fifty percent of all real <br /> estate lying outside of said land, but within two hundred feet of <br /> the boundaries thereof; from the owner of said land which would <br /> amend the "CODE OF ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" with <br /> respect to amending the Official Zoning Map and the zoning district <br /> boundaries of Section 5 of Ordinance No. 248 ( "ZONING ORDINANCE ") by <br /> rezoning said land from R -1 ( "SINGLE FAMILY RESIDENCE DISTRICT ") to <br /> R -2 ( "ONE AND TWO- FAMILY RESIDENCE DISTRICT "); and, <br /> WHEREAS, it is the desire of the City Council that said <br /> proposed amendment to rezone the said parcels of land from R -1 to <br /> R -2 along with any agreement pursuant to Section 414.5 of the 1989 <br /> Iowa Code, as amended, be considered by the Clive Plan and Zoning <br /> Commission and such Commission file its report with the City Council <br /> prior to the time established herein for public hearing on said <br /> • proposed amendment; and <br /> WHEREAS, the proposed amendment to rezone the said parcels of <br /> land from R -1 to R -2 has been reduced to ordinance form and a public <br /> hearing upon the proposed Ordinance should be held and a time and <br /> place for hearing thereon should be fixed. <br />
