t -, <br /> Resolution No. p in V <br /> RESOLUTION APPROVING CITY OF DES MOINES, IOWA <br /> MEMORANDUM OF UNDERSTANDING <br /> 40 FOR COMMUNITY SPONSORED AUTOMATED FLOOD WARNING SYSTEM <br /> AND AUTHORIZING EXECUTION OF THE SAME <br /> WHEREAS, the National Oceanic and Atmospheric Administration (NOAA) <br /> National Weather Service (NWS) has proposed to the City of Des Moines, Iowa, the <br /> City of West Des Moines, Iowa, the City of Clive, and the State of Iowa Department <br /> of Transportation a mutual assistance program designed to develop an Automated <br /> Flood Warning System for the Metropolitan Area of Des Moines oriented primarily <br /> on Walnut Creek; and <br /> WHEREAS, in meetings between representatives of such parties the location <br /> • and description of proposed components of such a system have been defined and <br /> tentative cost parameters determined; and <br /> WHEREAS, the allocation of the responsibilities for the installation and <br /> construction of such components has been similarly tentatively resolved subject <br /> to the approval of the governing bodies of each party to the development and <br /> operation of such system and is now contained in a proposed "City of Des Moines <br /> Memorandum of Understanding For Community Sponsored Automated Flood Warning <br /> System ", a copy of which is hereto attached and by this reference made a part <br /> thereof; and <br /> WHEREAS, such proposed agreement appears to be in the best interests of <br /> III the cities of Des Moines, West Des Moines and Clive and the Iowa State Department <br /> of Transportation. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, OF THE <br /> CITY OF CLIVE, IOWA: <br /> 1 . That the said attached Memorandum of Understanding be and is hereby <br /> approved. <br /> 2. That the Mayor be and is hereby authorized and directed to execute <br /> said Memorandum of Understanding for and on behalf of the City of Clive, Iowa; <br /> and the City Clerk be and is hereby authorized and directed to attest to the <br /> signature of the Mayor and affix the seal of the City to the same. <br /> 3. That such Memorandum of Understanding shall be submitted for approval <br /> to: <br /> A. The Attorney General of the State of Iowa as required by Section <br /> 28E.9, Code of Iowa 1987. <br /> B. The Iowa State Office of Emergency Management as required by <br /> Section 28E.10, Code of Iowa 1987. <br /> 4. That such Memorandum of Understanding shall be filed and recorded <br /> as provided by Section 28E.8, Code of Iowa 1987. <br /> 5. Upon such approval and upon such filing and recording the Memorandum <br /> of Understanding shall be of full force and effect. <br /> 6. It is understood that the City of Des Moines shall be the lead agency <br /> in soliciting such approvals and in doing such filing and recording. <br /> 7. In the event statutorily required approvals prove to be impossible to <br /> III obtain or obtainable only upon condition, the City of Des Moines shall so advise <br /> the other parties to such Memorandum of Understanding. <br /> 8.
