When the rental units
were inspected during the required audit inspection for the Rental Housing Program, it was
discovered that the windows did not meet the minimum requirements and needed to be
replaced with compliant windows (either to the code that was in place at the time of the
installation or current code requirement of 5.7 sf).
The applicant and property owner,Avrum Levin, requested a variance to allow the existing
egress windows to remain in place citing that even a compliant window would not allow a
firefighter with a full rescue suit on to make access and that firefighters would just break in
the window if they could not gain access.
