Clive <br />Community Development <br />1900 NW 114th ST <br />Clive, IA 50325 <br />BOARD OF ADJUSTMENT MINUTES (515)223-6221 <br />April 18, 2017 (515)457-3091 Fax <br />www.cityofclive.com <br />POOLE CALLED THE MEETING TO ORDER AT 6:00 P.M. <br />PRESENT: FORTE, SIKUTE, HAYEK, POOLE <br />ABSENT: MILLER <br />STAFF: PFALTZGRAFF, RIVERA <br />MOTION WAS MADE BY HAYEK, SECONDED BY FORTE to approve the March 22, 2017 <br />minutes <br />VOTE: YES - UNANIMOUS <br />Application #17-1010: 15164 Bryn Mawr Drive, Variance to Section 11-6-7: Dimension <br />Regulations (Minimum rear yard depth) <br />The applicant requested a variance to allow for the construction of a covered deck that will <br />encroach into the rear yard setback. The house is currently setback 44' 6" from the rear yard <br />which would allow for a 9' 6" covered deck, however, the property owner would like to <br />build a covered deck that would encroach approximately 4' 6" into the rear yard setback. <br />The applicant stated that the variance is needed in order to forgo the need to cantilever the <br />covered deck into the rear yard. While the application states that the cantilever option would <br />be 4'6", the Zoning Ordinance will only allow for 36" of projection into the required setback. <br />The applicant also has stated that due to the single story construction of the house, there is <br />not adequate space for a sufficiently sized covered deck. <br />MOTION WAS MADE BY SIKUTE, SECONDED BY FORTE to grant the variance to <br />Section 11-6-7 - Dimension Requirements: Rear Yard Setback for Case #17-1010 as requested <br />VOTE: YES - UNANIMOUS <br />Application: #17-1008: 13020 Woodlands Parkway, Variance to Section 11-4-8H: Swimming <br />pools are permitted in side and rear yards and Section 11-4-7 (B): Accessory Buildings <br />Setback <br />The applicant requested variances to allow for a swimming pool to be built in the secondary <br />front yard and for a detached garage to be placed without the required 5' side yard setback. <br />
