PLANNING AND ZONING <br />MEETING MINUTES <br />May 9, 2017 <br />BRAUER CALLED THE MEETING TO ORDER AT 5:30 P.M. <br />Clive <br />Community Development <br />1900 NW 114th ST <br />Clive, IA 50325 <br />(515)223-6221 <br />(515)457-3091 Fax <br />www.cityofclive.com <br />PRESENT: BENJAMIN, BANNISTER, BRAUER, HARRINGTON, HAVERMANN <br />ABSENT: DIKIS, KADING <br />STAFF: OLLENDIKE, RIVERA <br />MOTION WAS MADE BY BENJAMIN, SECONDED BY HARRINGTON to approve April <br />25, 2017 meeting minutes with a clarification to Bill Dikis' motion on Berkshire North <br />Townhomes Site Plan #3 - Consider permeable pavers to the unit driveways (not the street or <br />the drives), etc. <br />VOTE: YES - BENJAMIN, HARRINGTON, HAVERMANN, BRAUER <br />ABSTAIN - BANNISTER <br />Zoning Ordinance Amendment: Fireworks Sales <br />Due to the possibility of the Governor signing SF489 to allow the sale of fireworks in Iowa, the <br />City must regulate where sales can occur within our borders. The proposed zoning ordinance <br />would limit sales to M-1 & M-2 and the warehousing of fireworks to M-1. Additionally, staff <br />has determined that the 4 parking spaces required for a typical retail establishment would <br />likely not meet the demand of this type of business, so 10 spaces is being recommended. <br />The new law will not change the ability for stores to sell second-class consumer fireworks as <br />long as the sales area does not exceed 50% of the retail floor space. <br />The State will require some sort of licensing, so there is no need for the City to do the same. The <br />Fire Department may include some sort of inspection and fee, but Community Development <br />staff is not aware of anything at this time. <br />Benjamin suggested an edit to the Parking Requirements for Display Fireworks Sales - it <br />should read 1 space rather than 1 spaces. <br />MOTION WAS MADE BY HARRINGTON, SECONDED BY BANNISTER to <br />recommend the Zoning Ordinance Amendment regarding Fireworks Sales with edit <br />suggested. <br />VOTE: YES - UNANIMOUS <br />Being no further business before the Commission, the meeting was adjourned at 6:21 p.m. <br />
