BOARD OF ADJUSTMENT MINUTES
May 16, 2017
POOLE CALLED THE MEETING TO ORDER AT 6:00 P.M.
PRESENT: FORTE, SIKUTE, MILLER, POOLE
ABSENT: HAYEK
STAFF: PFALTZGRAFF, RIVERA
Clive
Community Development
1900 NW 114th ST
Clive, IA 50325
(515)223-6221
(515)457-3091 Fax
www.cityofclive.com
MOTION WAS MADE BY FORTE, SECONDED BY SIKUTE to approve the April 18, 2017
minutes
VOTE: YES - UNANIMOUS
Application #17-1009: 1673 NW 91st ST, Variance to Section 11-6-7: Dimension Regulations
(Minimum rear yard depth)
The applicant requested a 7' variance to allow for the construction of an addition on the rear
of their home. Due to the constraints of the property (floodway and sanitary sewer
easement), there is limited room to allow for the proposed addition. The homeowner stated
there is significant hardship due to the limited area available to him for the addition to his
home. There is a 30' sanitary sewer easement that runs diagonally southeast into the yard
making it difficult to add onto his home to the north and northeast. Additionally,
approximately 40% of the property (rear yard to the north-east) is impacted by the
regulatory floodway which does not allow for any fill or improvements that could impact
the conveyance of floodwaters.
The board members agreed that a hardship exists due to the floodway and sanitary sewer
easement, and that the proposed addition would not negatively impact the adjoining the
property owners.
MOTION WAS MADE BY MILLER, SECONDED BY FORTE to grant the variance as
requested to Section 11-6-7 - Dimension Regulations (Minimum rear yard depth)
Case #17-1009, 1673 NW 91st ST
VOTE: YES - UNANIMOUS
Application #17-1016: 8383 University BLVD, Variance to Section 11-4-8E: Domesticated
Animal Runs
