RESOLUTION NO. /1/9P <br /> RESOLUTION APPROVING A DIVISION AND SPREAD PRELIMINARY <br /> ASSESSMENT SCHEDULE AS TO PROPERTY PREVIOUSLY <br /> DESCRIBED AS LOT 11 IN COWNIE PARK PLAT, <br /> AN OFFICIAL AUDITOR'S PLAT IN CLIVE, POLK COUNTY, IOWA, <br /> HAVING BEEN REPLATTED AS LOTS 1, 2 AND 3 IN UNIVERSITY SQUARE, <br /> AN OFFICIAL PLAT INCLUDED IN AND FORMING A PART OF THE <br /> CITY OF CLIVE, POLK COUNTY, IOWA AND APPROVING AN <br /> ADDENDUM TO THE PETITION AND WAIVER FOR THE SPECIAL <br /> ASSESSMENT TO FACILITATE THE SAME <br /> WHEREAS, on the 22nd day of September, 1987, the Plan and Zoning <br /> Commission of the City of Clive, Iowa, did recommend the approval of <br /> both the Preliminary and Final Plat of property previously legally <br /> described as Lot 11 in Cownie Park Plat, an Official Auditor's Plat, <br /> now located in and forming a part of the City of Clive, Polk County, <br /> Iowa, so as to replat the same into Lots 1, 2 and 3 in University <br /> Square, an Official Plat, now located in and forming a part of the <br /> City of Clive, Polk County, Iowa; and <br /> WHEREAS, on the 'I _ day of November 1987, the City Council <br /> of the City of Clive, Iowa, did approve the final plat of University <br /> Square (the "Plat ") by Resolution; and <br /> WHEREAS, the owners of the Plat, Ronald 0. Burns and Deon E. <br /> Burns, husband and wife, have submitted a letter, by and through <br /> their attorney, William J. Lillis, requesting that pursuant to Sec- <br /> tion 409.1 and Section 384.61, of the 1987 Code of Iowa, the City <br /> Council divide and spread the lien for special assessments which is <br /> imposed as against said Lot 11 in Cownie Park Plat pursuant to a <br /> Petition and Waiver for special assessment and the Preliminary <br /> Assessment Schedule therefor, upon and across Lots 1, 2 and 3 of the <br /> plat; and <br /> WHEREAS, in accordance with the provisions of Chapter 409.1 of <br /> the Code of Iowa, and Section 384.61 of the 1987 Code of Iowa, and <br /> pursuant to the terms and conditions of the submittal of the owners <br /> of the Plat as to the division and spread of said special <br /> assessment, the City Council has determined that said division and <br /> spread as requested by the owners of the Plat is reasonable and <br /> proper, and would be in the best interests of the City of Clive; and <br /> WHEREAS, in furtherance of said division and spread the City <br /> Council has determined that the Petition and Waiver and Preliminary <br /> Assessment Schedule establishing the lien of said special <br /> assessments be amended to reflect said division and spread. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF CLIVE, IOWA: <br /> 1. That the Second Addendum to Petition and Waiver, a copy of <br /> which is attached hereto, be and is hereby approved by this <br /> City Council; and the Mayor is hereby authorized and <br /> directed to execute the same on behalf of the City of <br /> • Clive, Iowa; and the City Clerk is hereby authorized and <br /> directed to attest to the signature of the Mayor, to affix <br /> the seal of the City to the same and cause said document to <br /> be recorded in the offices of the Polk County, Iowa, <br /> Recorder and Treasurer. <br /> 2. That the Preliminary Assessment Schedule for the property <br /> formerly described as Lot 11 in Cownie Park Plat, an <br /> Official Auditor's Plat, now located in and forming a part <br /> of the City of Clive, Polk County, Iowa, and pursuant to <br /> the replatting thereof now legally described as Lots 1, 2 <br />
