RESOLUTION NO. iY -IS <br /> RESOLUTION ACCEPTING FINAL PLAT OF WALNUT <br /> RIDGE CREEK NO. 3 AND GIVING APPROVAL <br /> THERETO, AND ACCEPTING STREETS AND CERTAIN <br /> IMPROVEMENTS THEREIN, AND ACCEPTING AN AGREEMENT <br /> AND BONDS RELATING THERETO <br /> WHEREAS, the preliminary plat and accompanying materials for <br /> Walnut Ridge Creek Plat No. 3 had been filed with the City Clerk <br /> of the City of Clive, Iowa, by Iowa Realty, Co., Inc.; and <br /> WHEREAS, preliminary approval of the preliminary plat of <br /> Walnut Ridge Creek Plat No. 3 has previously been given by the <br /> Clive City Council at a regular meeting thereof; and <br /> WHEREAS, Iowa Realty, Co., Inc. has requested final approval <br /> of the plat of Walnut Ridge Creek Plat No. 3; and <br /> WHEREAS, the Clive Plan and Zoning Commission has recommended <br /> that the plat of Walnut Ridge Creek No. 3 be approved; and <br /> WHEREAS, the water lines, sanitary sewers, storm sewers and <br /> streets have been substantially installed in Walnut Ridge Creek <br /> Plat No. 3 and are to be completed and inspected by and approved <br /> by the City of Clive pursuant to an agreement signed by Iowa <br /> Realty, Co., Inc. dated September 6, 1984, binding Iowa Realty, <br /> Co., Inc. to complete certain items with respect to sanitary <br /> sewers, storm sewers, water mains, streets, sidewalks and a tennis <br /> court contained within said plat (hereinafter referred to as THE <br /> AGREEMENT) and in addition acceptable maintenance bonds relating <br /> thereto have been provided to the City of Clive; and <br /> WHEREAS, sidewalks and an agreed upon and planned tennis court <br /> have not been installed in Walnut Ridge Creek Plat No. 3, Iowa <br /> Realty, Co., Inc., has, however, executed THE AGREEMENT and posted <br /> bonds guaranteeing that the sidewalks and the tennis court will be <br /> constructed in accordance with the requirements of the City of <br /> Clive, the Construction Drawings for Walnut Ridge Creek Plat No. 3 <br /> and the provisions of the Code of Ordinances of the City of Clive <br /> within one year or upon the request of the City of Clive, <br /> whichever is sooner; and <br /> WHEREAS, Iowa Realty, Co., Inc. has submitted to the City of <br /> Clive a Warranty Deed for the Streets and Outlot X (tennis <br /> court /water detention) in Walnut Ridge Creek Plat No. 3 and <br /> easements for sanitary sewers, storm sewers and flowage and <br /> drainage channels; and <br /> WHEREAS, Iowa Realty, Co., Inc. has filed with the City of <br /> Clive Restrictive Covenants for Walnut Ridge Creek Plat No. 3, to <br /> be recorded with the final plat therefor; and <br /> WHEREAS, the plat of Walnut Ridge Creek Plat No. 3 and the <br /> documents relating thereto complies in all other respects with the <br /> • City of Clive's Subdivision Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF CLIVE, IOWA: <br /> That the plat of Walnut Ridge Creek Plat No. 3 be and the <br /> same is hereby accepted and approval be and the same is hereby <br /> given thereto by the City Council of the City of Clive, Polk <br /> County, Iowa. <br />
