• <br /> RESOLUTION NO. 84 - <br /> RESOLUTION <br /> A RESOLUTION CALLING A SPECIAL ELECTION ON THE QUESTION OF <br /> INCREASING THE HOTEL AND MOTEL TAX FROM THE CURRENT TAX RATE <br /> OF 5% TO A NEW TAX RATE OF 7% TO BE HELD AT THE TIME OF AND AS <br /> A PART OF THE CITY'S GENERAL ELECTION ON NOVEMBER 6, 1984. <br /> WHEREAS, the City of Clive, Iowa (hereinafter referred to as <br /> the "City ") is a municipal corporation organized and existing as a <br /> city under the laws and the Constitution of the State of Iowa, and <br /> is authorized and empowered by Chapter 422A of the Code of Iowa, <br /> as amended, to impose by ordinance a hotel and motel tax in an <br /> amount not in excess of 7% of the gross receipts from rentals by <br /> • hotels and motels within its corporate boundaries, subject to the <br /> approval of a majority of those voting on the question in an elec- <br /> tion held at the time of the City's general election; <br /> WHEREAS, the imposition of a 5% hotel and motel tax by the <br /> City was submitted to the qualified electors of the City for their <br /> approval at a special election held at the time of and as a part <br /> of the City's general election on November 7, 1978, and was ap- <br /> proved by a majority of those voting on said question in said <br /> general election; <br /> WHEREAS, Section 422A.1 of the Code of Iowa provides that a <br /> city may increase the rate of the hotel and motel tax only after <br /> an election held at the time of that city's general election at <br /> which a majority of those voting on the question favor such in- <br /> crease; <br /> WHEREAS, the next general election, as defined in Section <br /> 39.3(3) of the Code of Iowa, will be Tuesday, November 6, 1984; <br /> and <br /> WHEREAS, the City proposes to consider for purposes of <br /> adoption an Ordinance conditionally providing for an increase in <br /> the rate of said tax from 5% to 7% and wishes to seek approval of <br /> said increase by the qualified electors of the City. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CLIVE, <br /> IOWA, AS FOLLOWS: <br /> Section 1. That there is hereby called a special election of <br /> the qualified electors of the City of Clive, Iowa, on Tuesday, the <br /> 6th day of November, 1984, at which election there shall be sub- <br /> mitted to the qualified electors of said City the following ques- <br /> tion, to -wit: <br /> "Shall the City of Clive, Iowa be authorized to increase <br /> the hotel and motel tax from the current tax rate of five <br /> percent (5 %) to a new tax rate of seven percent (7 %) <br /> imposed within the corporate boundaries of the City upon <br /> the gross receipts from the renting of any and all sleep- <br /> ing rooms, apartments, or sleeping quarters in any hotel, <br /> motel, inn, public lodging house, rooming house, or tour- <br /> ist court, or in any place where sleeping accommodations <br /> are furnished to transient guests for rent, whether with <br /> or without meals (except the gross receipts from the <br /> renting of sleeping rooms in dormitories and in memorial <br /> unions at all universities and colleges), while rented by <br /> the same person for not more than 31 consecutive days, in <br /> accordance with the provisions of Chapter 422A of the <br /> Code of Iowa and the Code of Ordinances of the City ?" <br /> Section 2. That the form of ballot to be used at said elec- <br /> tion shall be as follows: (a) in those precincts using paper <br />
