RESOLUTION NO . ( Y, 9 l <br /> RESOLUTION APPROVING FURTHER REVISION TO <br /> THE ARBOR OAKS COMMUNITY UNIT PLAN <br /> WHEREAS, the City of Clive did on April 17, 1975, approve a <br /> Community Unit Plan for the development of that area now known as <br /> Arbor Oaks in the City of Clive; and <br /> WHEREAS, the owners of Arbor Oaks platted a portion of the <br /> property contained in said Community Unit Plan as Arbor Oaks <br /> Estates, Plat No. 5, on February 21, 1980; and <br /> WHEREAS, the said owners have requested a revision to said <br /> Community Unit Plan relating to the permitted use of Lot 20 of <br /> Arbor Oaks, Plat 5 and a decrease in the number of lots designated <br /> • as eligible for development as two - family detached dwellings; and <br /> WHEREAS, the Clive Plan and Zoning Commission has reviewed the <br /> requested revision and recommended to the Clive City Council that <br /> the Revised Community Unit Plan be approved; and <br /> WHEREAS, the Clive City Council has carefully considered the <br /> proposed revision to the Community Unit Plan, and in its review <br /> has considered: <br /> 1. That the location, design, and construction of <br /> structures in the proposed revised plan adequately safe- <br /> guards the health, safety, and general welfare of persons <br /> residing in adjacent or surrounding property; and <br /> 2. That the revised plan shall not impair an adequate <br /> supply of light and air to surrounding property; and <br /> 3. That the revised plan shall not unduly increase <br /> congestion in the streets or public danger of fire and <br /> safety; and <br /> 4. That the revised plan shall be in accord with the <br /> intent, purpose, and spirit of this Ordinance and the <br /> Comprehensive Plan of the City; and <br /> 5. That the revised plan will result in a reduction of <br /> nine lots allowed for development of two - family detached <br /> dwellings. <br /> WHEREAS, the total number of dwelling units provided for in <br /> the proposed revised plan is less than that which would otherwise <br /> be permitted by the Clive Zoning Ordinance; and <br /> WHEREAS, the Clive City Council deems the proposed Revised <br /> Community Unit Plan for the design of the entire neighborhood <br /> encompassed by it to be in the best interests of the public and <br /> the community and compatible with and complementary to the neigh - <br /> boring and surrounding property. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CLIVE CITY COUNCIL that <br /> the existing Arbor Oaks Community Unit Plan dated April 17, 1975, <br /> as revised on April 21, 1977, and January 21, 1982, be and is <br /> hereby further modified and revised as follows: <br /> • Y <br /> 1. All existing zoning regulations and ordinances shall <br /> be applicable to all lots except: <br /> a. That all properties located within the R -1_ zon- <br /> ing district shall be developed according to the <br /> Revised Community Unit Plan and the plattings sub - <br />
