:Y <br /> RESOLUTION NO. <br /> RESOLUTION ACCEPTING FINAL PLAT OF WESTPOINTE <br /> SQUARE PLAT 2 AND GIVING APPROVAL THERETO, <br /> AND ACCEPTING AN AGREEMENT AND BOND RELATED <br /> TO IMPROVEMENTS THEREIN <br /> WHEREAS, the preliminary plat and accompanying materials for <br /> Westpointe Square Plat 2 have been filed with the City Clerk of the <br /> City of Clive, Iowa, by Keck, Inc., Westpointe Car Wash, Ltd., and D <br /> M Investments (the "Proprietors and <br /> WHEREAS, preliminary approval of the preliminary plat of West- <br /> pointe Square Plat 2 has previously been given by the Clive Plan and <br /> Zoning Commission at a regular meeting thereof; and <br /> WHEREAS, the Proprietors have requested final approval of the <br /> final plat of Westpointe Square Plat 2; and <br /> WHEREAS, the Clive Plan and Zoning Commission has recommended <br /> that said final plat of Westpointe Square Plat 2 be approved; and <br /> WHEREAS, certain public and private accesses from public streets <br /> abutting said Westpointe Square Plat 2 have not been installed as <br /> required by the City of Clive; however, the Proprietors have signed <br /> and submitted an "Agreement" and posted a bond in the form of a <br /> certified check guarantying that said improvements will be con- <br /> structed in accordance with the requirements of the City of Clive <br /> prior to the issuance of an occupancy permit for Lots 2 or 3 of said <br /> Plat, but in no event later than one (1) year from the 19th day of <br /> February, 1987; and <br /> WHEREAS, no public streets, sanitary sewers, storm sewers, or <br /> water lines are required to be installed in Westpointe Square Plat <br /> 2; and <br /> WHEREAS, no public improvement maintenance bond is required as <br /> part of this Westpointe Square Plat 2; and <br /> WHEREAS, the Proprietors have filed with the City of Clive cer- <br /> tain Restrictive Covenants for Westpointe Square Plat 2 to be re- <br /> corded with the final plat therefor; and <br /> WHEREAS, the Proprietors have also filed with the City of Clive <br /> certain public Ingress /Egress Easements, and agreements entitled <br /> "Roadway Construction and Easement Agreement" and "Public Access <br /> Drive Construction Agreement and Petition and Waiver" for Westpointe <br /> Square Plat 2 to be recorded with the final plat therefor; and <br /> WHEREAS, the plat of Westpointe Square Plat 2 and the documents <br /> relating thereto comply in all other respects with the City of <br /> Clive's Subdivision Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> 1,.r OF CLIVE, IOWA: <br /> 1. That the official final plat of Westpointe Square Plat 2 be <br /> and the same is hereby accepted, and final approval be and <br /> the same is hereby given thereto, by the City Council of <br /> the City of Clive, Polk County, Iowa. <br /> 2. That the City of Clive does hereby accept the Restrictive <br /> Covenants and public Ingress /Egress Easements in Westpointe <br /> Square Plat 2, as dedicated by the Proprietors. <br /> -1- <br />
