P7 -a <br /> RESOLUTION SETTING TIME AND PLACE FOR PUBLIC <br /> HEARING ON PROPOSED CHANGES TO THE "CODE OF <br /> ORDINANCES OF THE CITY OF CLIVE, IOWA, 1886" WITH <br /> RESPECT TO AMENDING THE OFFICIAL ZONING MAP AND <br /> ZONING DISTRICT BOUNDARIES (SECTION 5 OF <br /> ORDINANCE NO. 248) FOR CERTAIN PROPERTY IN THE <br /> CITY OF CLIVE, IOWA. <br /> WHEREAS, the following legally described land is located in <br /> the City of Clive, Iowa: <br /> Lot 12, and the east one -half (1/2) of Lot 13, WESTHOPE, <br /> an official plat now being in and forming part of the <br /> City of Clive, Polk County, Iowa; except that part or <br /> portion of said described real estate located within the <br /> Floodway as shown on the "Floodway, Floodway Boundary and <br /> Floodway Map" dated March 1, 1984 (County of Polk, Iowa, <br /> Unincorporated Areas, Panels 90 and 155 of 220) (The <br /> "Map as established by the Federal Emergency Management <br /> Agency of the United States Department of Housing and <br /> Urban Development, which map is by this reference <br /> incorporated herein. <br /> AND WHEREAS, the City Council of the City of Clive has <br /> received a proposal from the City staff which would amend the "CODE <br /> OF ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" with respect to <br /> amending the Official Zoning Map and the zoning district boundaries <br /> of Section 5 of Ordinance No. 248 "ZONING ORDINANCE by rezoning <br /> said land from R -1 "SINGLE FAMILY RESIDENCE DISTRICT to C -1 <br /> "COMMERCIAL DISTRICT <br /> WHEREAS, it is the desire of the City Council that said <br /> proposed amendment to rezone the said land from R -1 to C -1 be <br /> considered by the Clive Plan and Zoning Commission and such <br /> Commission file its report with the City Council prior to the time <br /> established herein for public hearing on said proposed amendment; and <br /> WHEREAS, the proposed amendment to rezone the said land from <br /> R -1 to C -1 has been reduced to ordinance form and a public hearing <br /> upon the proposed Ordinance should be held and a time and place for <br /> hearing thereon should be fixed. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF CLIVE, IOWA: <br /> 1. That a public hearing be held by the Clive City Council <br /> on the aforesaid proposed Ordinance amending the "CODE OF <br /> ORDINANCES OF THE CITY OH CLIVE, IOWA, 1986" with respect <br /> to amending the Official Zoning Map and zoning district <br /> boundaries (Section 5 of Ordinance No. 248 "ZONING <br /> ORDINANCE to provide that the above described land be <br /> rezoned from R -1 "Single Family Residence District to <br /> C -1 "Commercial District at the Clive City Hall, 8505 <br /> Harbach Boulevard, in the City of Clive, Polk County, <br /> Iowa o'clock P.M. on the th day <br /> of 1987, at which time the City <br /> Council will consider any objections to the proposed <br /> amendments and will hear citizens and parties in interest. <br /> 2. That the Mayor and City Clerk be and are hereby <br /> authorized and instructed to give Notice of said public <br /> hearing in the form attached hereto, and by this <br /> reference incorporated herein, as required by law. <br /> 3. That the Plan and Zoning Commission is hereby directed to <br /> consider said proposed amendment and to file its report <br /> with the City Council prior to the time of said public <br /> hearing. <br /> 0 <br />
