RESOLUTION NO. /27 <br /> RESOLUTION SETTING TIME AND PLACE FOR PUBLIC <br /> HEARING ON PROPOSED CHANGES TO THE "CODE OF <br /> ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" WITH <br /> RESPECT TO AMENDING THE OFFICIAL ZONING MAP AND <br /> ZONING DISTRICT BOUNDARIES (SECTION 5 OF <br /> ORDINANCE NO. 248) FOR CERTAIN PROPERTY IN THE <br /> CITY OF CLIVE, IOWA. <br /> WHEREAS, the following legally described land is located in <br /> the City of Clive, Iowa: <br /> That part of the Hickman Road right -of -way lying south of <br /> the north line of Section 32, Township 79 North, Range 25 <br /> West of the 5th P.M. and north of and adjacent to lot 12 <br /> and the east 1/2 of lot 13, Westhope, an official plat <br /> now being in and forming a part of the City of Clive, <br /> Polk County, Iowa. <br /> The west one -half (1/2) of Lot 13, WESTHOPE, an official <br /> plat now being in and forming part of the City of Clive, <br /> Polk County, Iowa; and that part of Hickman Road <br /> right -of -way lying south of the north line of Section 32, <br /> Township 79 North, Range 25 West of the 5th P.M. and <br /> north of and adjacent to the above described land, except <br /> that part or portion of said described real estate <br /> located within the Floodway as shown on the "Floodway, <br /> Floodway Boundary and Floodway Map" dated March 1, 1984 <br /> (County of Polk, Iowa, Unincorporated Areas, Panels 90 <br /> and 155 of 220) (The "Map as established by the Federal <br /> Emergency Management Agency of the United States <br /> Department of Housing and Urban Development, which map is <br /> by this reference incorporated herein. <br /> AND WHEREAS, the City Council of the City of Clive has adopted <br /> the "1987 AMENDMENTS TO THE 1978 COMPREHENSIVE PLAN FOR THE CITY OF <br /> CLIVE, IOWA" wherein it is recommended to amend the "CODE OF <br /> ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" with respect to <br /> amending the Official Zoning Map and the zoning district boundaries <br /> of Section 5 of Ordinance No. 248 "ZONING ORDINANCE by rezoning <br /> said land from R -1 "SINGLE FAMILY RESIDENCE DISTRICT to C -1 <br /> "COMMERCIAL DISTRICT <br /> WHEREAS, it is the desire of the City Council that said <br /> proposed amendment to rezone the said land from R -1 to C -1 be <br /> considered by the Clive Plan and Zoning Commission and such <br /> Commission file its report with the City Council prior to the time <br /> established herein for public hearing on said proposed amendment; and <br /> WHEREAS, the proposed amendment to rezone the said land from <br /> R -1 to C -1 has been reduced to ordinance form and a public hearing <br /> upon the proposed Ordinance should be held and a time and place for <br /> hearing thereon should be fixed. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF CLIVE, IOWA: <br /> 1. That a public hearing be held by the Clive City Council <br /> on the aforesaid proposed Ordinance amending the "CODE OF <br /> ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" with respect <br /> to amending the Official Zoning Map and zoning district <br /> boundaries (Section 5 of Ordinance No. 248 "ZONING <br /> ORDINANCE to provide that the above described land be <br /> rezoned from R -1 "Single Family Residence District to <br /> C -1 "Commercial District at the Clive City Hall, 8505 <br /> Harbach Boulevard, in the City of Clive, Po County, <br /> Iowa t 7; Y© o'clock P.M. on the /C, th day <br /> of .Q J� 1987, at which time he City <br /> Counci w211 consider any objections to the proposed <br /> amendments and will hear citizens and parties in interest. <br />
