Ch <br /> 1110 a RESOLUTION NO. <br /> RESOLUTION SETTING TIME AND PLACE FOR PUBLIC <br /> HEARING ON PROPOSED CHANGES TO THE "CODE OF <br /> ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" WITH <br /> RESPECT TO AMENDING THE OFFICIAL ZONING MAP AND <br /> ZONING DISTRICT BOUNDARIES (SECTION 5 OF <br /> ORDINANCE NO. 248) FOR CERTAIN PROPERTY IN THE <br /> CITY OF CLIVE, IOWA. <br /> WHEREAS, the following legally described land is located in <br /> the City of Clive, Iowa: <br /> The east 336.75 feet of the south 1/2 of the southeast <br /> 1/4 of the southeast 1/4 of Section 31, Township 79 <br /> North, Range 25 West of the 5th P.M. and also; <br /> Beginning, at the north 1/4 corner of Section 31, <br /> Township 79 north, Range 25 West of the 5th P.M.; thence <br /> east along the north line of said Section 31 to the <br /> northeast corner of said Section 31; thence south along <br /> the east line of said Section 31, 878.0 feet thence west <br /> to a point on the west line of the northeast 1/4 of said <br /> Section 31, said point being 876.7 feet south of said <br /> north 1/4 corner of Section 31; thence north 876.7 feet <br /> to the point of beginning, except that real estate <br /> located within the Floodway as shown on the "Floodway, <br /> Flood Boundary and Floodway Map" dated March 1, 1984 <br /> (County of Polk, Iowa, Unincorporated Areas, Panels 90 <br /> and 155 of 220) (The "Map) as established by the Federal <br /> Emergency Management Agency of the United States <br /> Department of Housing and Urban Development, which map is <br /> by this reference incorporated herein, and also; <br /> Lot 1, 2, 3, 4, and 5, Universal Acres, an official plat <br /> and that part of NW 128th Street right -of -way lying east <br /> of the west line of Section 32, Township 79 North, Range <br /> 25 West of the 5th P.M. and west of and adjacent to the <br /> above described land and that part of University Avenue <br /> right -of -way lying north of the south line of said <br /> Section 32 and south of and adjacent to the above <br /> described land and also; <br /> The south 915.86 feet of the east 1/2 of the southwest <br /> 1/4 of the southwest 1/4 of Section 32, Township 79 <br /> North, Range 25 West of the 5th P.M. <br /> AND WHEREAS, the City Council of the City of Clive has adopted <br /> the "1987 AMENDMENTS TO THE 1978 COMPREHENSIVE PLAN FOR THE CITY OF <br /> CLIVE, IOWA" wherein it is recommended to amend the "CODE OF <br /> ORDINANCES OF THE CITY OF CLIVE, IOWA, 1986" with respect to <br /> amending the Official Zoning Map and the zoning district boundaries <br /> of Section 5 of Ordinance No. 248 "ZONING ORDINANCE by rezoning <br /> said land from R -1 "SINGLE FAMILY RESIDENCE DISTRICT to C -4 <br /> "COMMERCIAL DISTRICT <br /> WHEREAS, it is the desire of the City Council that said <br /> proposed amendment to rezone the said land from R -1 to C -4 be <br /> considered by the Clive Plan and Zoning Commission and such <br /> Commission file its report with the City Council prior to the time <br /> established herein for public hearing on said proposed amendment; and <br /> WHEREAS, the proposed amendment to rezone the said land from <br /> R -1 to C -4 has been reduced to ordinance form and a public hearing <br /> upon the proposed Ordinance should be held and a time and place for <br /> hearing thereon should be fixed. <br />
