RESOLUTION NO. 89 -I <br /> RESOLUTION SETTING TIME AND PLACE FOR PUBLIC HEARING ON <br /> PROPOSED CHANGES TO THE "CODE OF ORDINANCES OF THE CITY <br /> OF CLIVE, IOWA, 1986" WITH RESPECT TO AMENDING THE <br /> OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES <br /> (SECTION 5 OF ORDINANCE NO. 248) FOR CERTAIN PROPERTY IN <br /> THE CITY OF CLIVE, IOWA. <br /> WHEREAS, the following legally described land is located in <br /> the City of Clive, Iowa: <br /> A parcel of land in Outlot "E, Country Club Plat 1, an <br /> official plat, City of Clive, Polk County, Iowa, that is <br /> more particularly described as follows: <br /> Beginning at the northerly most corner of said Outlot <br /> Loe "E thence S83° 08'45 "E, 893.92 feet along the north <br /> line of Outlot "E" to a point; thence S58° 25'45 "E, <br /> 513.88 feet along the north line of Outlot "E" to a <br /> point; thence S17° 34'04 "E, 367.89 feet along the east <br /> line of Outlot "E" to a point; thence N89° 52'14 "W, <br /> 1362.84 feet to a point on the south line of Outlot "E <br /> thence N59° 20'10 "W, 370.04 feet to a point on the west <br /> line of Outlot "E thence N24 35'46 "E, 588.01 feet <br /> along the west line of Outlot "E" to the point of <br /> beginning and containing 20.858 acres more or less; <br /> except that part or portion of said described real estate <br /> located within the Floodway as shown on the "Floodway, <br /> Floodway Boundary and Floodway Map" dated March 1, 1984 <br /> (County of Polk, Iowa, Unincorporated Areas, Panels 90 <br /> and 155 of 220) (The "Map" as established by the <br /> Federal Emergency Management Agency of the United States <br /> Department of Housing and Urban Development, which map is <br /> by this reference incorporated herein. <br /> AND WHEREAS, the City Council of the City of Clive has <br /> received a petition signed by the owners of over fifty percent of <br /> all real estate lying outside of said land, but within two hundred <br /> feet of the boundaries thereof; from the owner of said land which <br /> would amend the "CODE OF ORDINANCES OF THE CITY OF CLIVE, IOWA, <br /> 1986" with respect to amending the Official Zoning Map and the <br /> zoning district boundaries of Section 5 of Ordinance No. 248 <br /> "ZONING ORDINANCE by rezoning said land from C -3 "COMMERCIAL <br /> DISTRICT to R -4 "ATTACHED DWELLING DISTRICT and, <br /> WHEREAS, it is the desire of the City Council that said <br /> proposed amendment to rezone the said parcels of land from C -3 to <br /> R -4 be considered by the Clive Plan and Zoning Commission and such <br /> Commission file its report with the City Council prior to the time <br /> established herein for public hearing on said proposed amendment; <br /> and <br /> WHEREAS, the proposed amendment to rezone the said parcels of <br /> land from C -3 to R -4 has been reduced to ordinance form and a public <br /> hearing upon the proposed Ordinance should be held and a time and <br /> place for hearing thereon should be fixed. <br />
