RESOLUTION NO. 89—/1 <br /> RESOLUTION ACCEPTING FINAL PLAT OF <br /> BAY HILL PLAT NO. 1 AND GIVING APPROVAL <br /> THERETO, AND ACCEPTING STREETS AND CERTAIN <br /> IMPROVEMENTS THEREIN <br /> WHEREAS, the preliminary plat and accompanying materials for <br /> Bay Hill Plat No. 1, an Official Plat, now included in and form- <br /> ing a part of the City of Clive, Polk County, Iowa, have been <br /> filed with the City Clerk of the City of Clive, Iowa, by Cob- <br /> blestone Development, Ltd. d /b /a Colby Development Company; and <br /> WHEREAS, preliminary approval of the preliminary plat of Bay <br /> Hill Plat No. 1 has previously been given by the Clive City Coun- <br /> cil at a regular meeting thereof; and <br /> WHEREAS, Cobblestone Development, Ltd. d /b /a Colby Develop- <br /> ment Company has requested final approval of the plat of Bay Hill <br /> Plat No. 1; and <br /> WHEREAS, the Clive Plan and Zoning Commission has recom- <br /> mended that the plat of Bay Hill Plat No. 1 be approved; and <br /> WHEREAS, the water mains, sanitary sewers, storm sewers and <br /> streets have been installed in Bay Hill Plat No. 1 which have <br /> been inspected by and approved by the City of Clive and accep- <br /> table maintenance bonds relating thereto have been provided to <br /> the City of Clive; and <br /> WHEREAS, sidewalks have not been installed in Bay Hill Plat <br /> No. 1, however, Cobblestone Development, Ltd. d /b /a Colby Devel- <br /> opment Company has posted bonds guaranteeing that the sidewalks <br /> will be constructed in accordance with the requirements of the <br /> City of Clive, the Construction Drawings for Bay Hill Plat No. 1 <br /> and the provisions of the Code of Ordinances of the City of Clive <br /> within one year of July 20, 1989 or upon the construction of <br /> residential structures on the lots of Bay Hill Plat No. 1, <br /> whichever is sooner; and <br /> WHEREAS, Cobblestone Development, Ltd. d /b /a Colby Devel- <br /> opment Company has submitted to the City of Clive a Warranty Deed <br /> for the Streets in Bay Hill Plat No. 1 and easements for sanitary <br /> sewers, storm sewers and flowage and drainage channels; and <br /> WHEREAS, Cobblestone Development, Ltd. d /b /a Colby Devel- <br /> opment Company has filed with the City of Clive a Declaration of <br /> Covenants, Conditions and Restrictions for Bay Hill Townhomes for <br /> Bay Hill Plat No. 1, to be recorded with the final plat therefor; <br /> and <br /> WHEREAS, the plat of Bay Hill Plat No. 1 and the documents <br /> relating thereto comply in all other respects with the City of <br /> Clive's Subdivision Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF CLIVE, IOWA: <br /> That the plat of Bay Hill Plat No. 1 be and the same is <br /> hereby accepted and approval be and the same is hereby given <br /> thereto by the City Council of the City of Clive, Polk County, <br /> Iowa. <br /> BE IT FURTHER RESOLVED that the City of Clive does hereby <br /> accept the following: the said water mains, storm sewers, <br /> sanitary sewers and streets located in Bay Hill Plat No. 1; and <br /> the Storm Sewer Easements, Sanitary Sewer Easements, and the <br /> Surface Water Flowage and Drainage Easements in Bay Hill Plat No. <br /> 1. <br />
