RESOLUTION NO. 89 <br /> RESOLUTION ACCEPTING FINAL PLAT OF <br /> COUNTRY CLUB PLAT 5 AND GIVING APPROVAL <br /> THERETO, AND ACCEPTING STREETS AND CERTAIN <br /> IMPROVEMENTS THEREIN, AND ACCEPTING <br /> AN AGREEMENT AND BONDS RELATING THERETO <br /> WHEREAS, the preliminary plat and accompanying materials for <br /> Country Club Plat 5, an Official Plat, now included in and form- <br /> ing a part of the City of Clive, Polk County, Iowa, have been <br /> filed with the City Clerk of the City of Clive, Iowa, by Iowa <br /> Realty Co., Inc.; and <br /> WHEREAS, preliminary approval of the preliminary plat of <br /> Country Club Plat 5 has previously been given by the Clive City <br /> Council at a regular meeting thereof; and <br /> WHEREAS, Iowa Realty Co., Inc. has requested final approval <br /> of the plat of Country Club Plat 5; and <br /> WHEREAS, the Clive Plan and Zoning Commission has recom- <br /> mended that the plat of Country Club Plat 5 be approved; and <br /> WHEREAS, the water mains, sanitary sewers, storm sewers and <br /> streets have been installed in Country Club Plat 5 which have <br /> been inspected by and approved by the City of Clive and accep- <br /> table maintenance bonds relating thereto have been provided to <br /> the City of Clive; and <br /> WHEREAS, sidewalks have not been installed in Country Club <br /> Plat 5, however, Iowa Realty Co., Inc. has signed an agreement <br /> and posted bonds guaranteeing that the sidewalks will be con- <br /> structed in accordance with the requirements of the City of <br /> Clive, the Construction Drawings for Country Club Plat 5 and the <br /> provisions of the Code of Ordinances of the City of Clive within <br /> one year of July 20, 1989 or upon the request of the City of <br /> Clive, whichever is sooner; and <br /> WHEREAS, Iowa Realty Co., Inc. has submitted an "Agreement" <br /> dated July 20, 1989 relating to Country Club Plat 5. <br /> WHEREAS, Iowa Realty Co., Inc. has submitted to the City of <br /> Clive a Warranty Deed for the Streets in Country Club Plat 5 and <br /> easements for sanitary sewers, storm sewers and flowage and <br /> drainage channels; and <br /> WHEREAS, Iowa Realty Co., Inc. has filed with the City of <br /> Clive Building Restrictions and Protective Covenants and <br /> Maintenance Covenants for Common Area for Country Club Plat 5, to <br /> be recorded with the final plat therefor; and <br /> WHEREAS, the plat of Country Club Plat 5 and the documents <br /> relating thereto comply in all other respects with the City of <br /> Clive's Subdivision Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF CLIVE, IOWA: <br /> That the plat of Country Club Plat 5 be and the same is <br /> hereby accepted and approval be and the same is hereby given <br /> thereto by the City Council of the City of Clive, Polk County, <br /> Iowa. <br /> BE IT FURTHER RESOLVED that the City of Clive does hereby <br /> accept the following: the water mains, storm sewers, sanitary <br /> sewers and streets located in Country Club Plat 5; and the Storm <br /> Sewer Easement, the Storm Sewer and Overland Flowage Easement, <br /> and the Storm Sewer, Sanitary Sewer and Overland Flowage <br /> Easement. <br />
