t <br />Mr <br />V.M.1.1,TornIfffillrtfr 11 <br />1. <br />RESOLUTION NO. 194r? <br />RESOLUTION ACCEPTING FINAL PLAT OF <br />THE WOODLANDS PLAT NO. 1 AND GIVING APPROVAL <br />THERETO, AND ACCEPTING DEEDS AND EASEMENTS FOR <br />STREETS AND CERTAIN PUBLIC IMPROVEMENTS THEREIN, AND <br />ACCEPTING AN AGREEMENT AND BONDS RELATING THERETO <br />WHEREAS, the preliminary plat and accompanying materials for <br />The Woodlands Plat No. 1, an Official Plat, now included in and <br />forming a part of the City of Clive, Polk County, Iowa, have been <br />filed with the City Clerk of the City of Clive, Iowa, by Mid <br />America Investment Co.; and <br />WHEREAS, preliminary approval of the preliminary plat of The <br />Woodlands Plat No. 1 has previously been given by the Clive City <br />Council at a regular meeting thereof; and <br />WHEREAS, Mid America Investment Co. has requested final ap- <br />proval of the plat of The Woodlands Plat No. 1; and <br />WHEREAS, the Clive Plan and Zoning Commission has recom- <br />mended that the plat of The Woodlands Plat No. 1 be approved; and <br />WHEREAS, the water mina, sanitary sewers, storm sewers, <br />streets, and sidewalks have not been installed to the satis- <br />faction of the City in The Woodlands Plat No. 1, however, Mid <br />America Investment Co. has signed an agreemant and posted bonds <br />guaranteeing that the water mins, sanitary sewers, storm sewers, <br />streets, and sidewalks will be constructed in accordance with the <br />requirements of the City of Clive, the Construction Drawings for <br />The Woodlands Plat No. 1 and the provisions of the Code of Ordi- <br />nances of the City of Clive within one year of August 31, 1989 or <br />upon the request of the City of Clive, whichever is sooner; and <br />WHEREAS, Mid America Investment Co. has submitted an "Agree- <br />ment' dated August 31, 1989 relating to The Woodlands Plat No. 1. <br />WHEREAS, Mid America Investment Co. has submitted to the <br />City of Clive a Warranty Deed for the streets and public parka, <br />or such other purposes as the City may deem appropriate, in The <br />Woodlands Plat No. 1, and easements for public parks, water <br />lines, sanitary sewers, storm sewers, and flowage and drainage <br />channels; and <br />WHEREAS, Mid America Investment Co. has filed with the City <br />of Clive a Master Declaration of Covenants, Maintenance Covenants <br />for Common Area, and Protective Covenants, Restrictions and Ease- <br />ments for The Woodlands Plat No. 1, to be recorded with the final <br />plat therefor; and <br />WHEREAS, the plat of The Woodlands Plat No. 1 and the docu- <br />ments relating thereto comply in all other respects with the City <br />of Clive's Subdivision Ordinance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF CLIVE, IOWA: <br />That the plat of The Woodlands Plat No. 1 be and the same is <br />hereby accepted and approval be and the same is hereby given <br />thereto by the City Council of the City of Clive, Polk County, <br />Iowa. <br />BE IT FURTHER RESOLVED that the City of Clive does hereby <br />accept the easements for public parks, water lines, sanitary <br />sewers, storm sewers and flowage and drainage channels in The <br />Woodlands Plat No. 1. <br />BE IT FURTHER RESOLVED that the City of Clive does hereby <br />accept the Warranty Deed for Lots A, B, C, D, E, F, G, H, I and J <br />and Outlots V and Z in The Woodlands Plat No. 1. <br />x6147 1539 <br />
