RESOLUTION NO. &A;J? <br /> RESOLUTION ACCEPTING FINAL PLAT OF <br /> COUNTRY CLUB PLAT 3 AND GIVING APPROVAL <br /> THERETO, AND ACCEPTING CERTAIN STREETS AND CERTAIN <br /> IMPROVEMENTS THEREIN, AND ACCEPTING <br /> AN AGREEMENT AND BONDS RELATING THERETO <br /> WHEREAS, the preliminary plat and accompanying materials for <br /> Country Club Plat 3, an Official Plat, now included in and form- <br /> ing a part of the City of Clive, Polk County, Iowa, have been <br /> filed with the City Clerk of the City of Clive, Iowa, by Iowa <br /> Realty Co., Inc.; and <br /> WHEREAS, preliminary approval of the preliminary plat of <br /> Country Club Plat 3 has previously been given by the Clive City <br /> Council at a regular meeting thereof; and <br /> WHEREAS, Iowa Realty Co., Inc. has requested final approval <br /> of the plat of Country Club Plat 3; and <br /> WHEREAS, the Clive Plan and Zoning Commission has recom- <br /> mended that the plat of Country Club Plat 3 be approved; and <br /> WHEREAS, the water mains (except a 12 inch water main along <br /> N.W. 142nd Street), sanitary sewers, storm sewers and streets <br /> (except Lakeview Drive west of the West property line of Lot 75 <br /> and Lakeshore Drive northwest of the North property line of Lot <br /> 75) have been installed in Country Club Plat 3 which have been <br /> inspected by and approved by the City of Clive and acceptable <br /> maintenance bonds relating thereto have been provided to the City <br /> of Clive and with respect to the uninstalled watermains and <br /> streets acceptable performance bonds have been posted <br /> guaranteeing construction thereof; and <br /> WHEREAS, sidewalks have not been installed in Country Club <br /> Plat 3, however, Iowa Realty Co., Inc. has signed an agreement <br /> and posted bonds guaranteeing that the sidewalks will be con- <br /> structed in accordance with the requirements of the City of <br /> Clive, the Construction Drawings for Country Club Plat 3 and the <br /> provisions of the Code of Ordinances of the City of Clive within <br /> one year of November 1, 1989 or upon the request of the City of <br /> Clive, whichever is sooner; and <br /> WHEREAS, Iowa Realty Co., Inc. has submitted an "Agreement" <br /> dated Q b er �l.j 1989 relating to Country Club Plat 3. <br /> WHEREAS, Iowa Realty Co., Inc. has submitted to the City of <br /> Clive a Warranty Deed for the Streets in Country Club Plat 3 and <br /> easements for sidewalks, storm sewers and flowage and drainage <br /> channels; and <br /> WHEREAS, Iowa Realty Co., Inc. has filed with the City of <br /> Clive Building Restrictions and Protective Covenants for Country <br /> Club Plat 3, to be recorded with the final plat therefor; and <br /> WHEREAS, the plat of Country Club Plat 3 and the documents <br /> relating thereto comply in all other respects with the City of <br /> Clive's Subdivision Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF CLIVE, IOWA: <br /> That the plat of Country Club Plat 3 be and the same is <br /> hereby accepted and approval be and the same is hereby given <br /> thereto by the City Council of the City of Clive, Polk County, <br /> Iowa. <br /> BE IT FURTHER RESOLVED that the City of Clive does hereby <br /> accept the following: the water mains (except the 12 inch water <br />
